User Accounts & Age Requirement

To use our service, you must:

• Be at least 18 years of age. By creating an account, you represent and warrant that you are at least 18 years old. Inktoxicated is not intended for use by minors. We do not knowingly collect or solicit information from anyone under the age of 18.
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

Intellectual Property Rights

Your Content

• You retain all ownership rights to content you create or upload
• You grant us a license to process your content to provide our services
• You are responsible for ensuring you have rights to any content you upload
• AI-generated content based on your prompts belongs to you

Our Platform

The Inktoxicated platform, including its design, features, and technology, is protected by copyright and other intellectual property laws. You may not copy, modify, or reverse engineer any part of our service.

AI-Generated Content

Important Disclaimers:

• Accuracy: AI-generated content may contain errors, inaccuracies, or inconsistencies. You are responsible for reviewing and verifying all content before publication.
• Originality & Plagiarism: While our AI strives to create original content, AI-generated text may inadvertently reproduce or closely resemble existing copyrighted works, phrases, or passages. We cannot and do not guarantee that any AI-generated content is free from plagiarism or copyright infringement. You are solely responsible for running plagiarism checks and verifying the originality of all content before publication or distribution.
• Copyright Infringement Liability: You are solely responsible for ensuring your published work does not infringe on others' intellectual property rights. Inktoxicated shall not be held liable for any copyright infringement claims, plagiarism allegations, or intellectual property disputes arising from content generated through or published using our service. You agree to independently verify that your work does not violate any third-party rights before selling, distributing, or publishing it.
• Quality: AI-generated content is provided "as is" and may require human editing and refinement for professional publication.

Acceptable Use & Prohibited Content

You agree not to:

• Use the service for any illegal purpose or to violate any laws
• Create content that is defamatory, obscene, or infringes on others' rights
• Generate, request, or distribute any content that sexualizes, exploits, or endangers minors in any way, including but not limited to child sexual abuse material (CSAM), suggestive depictions of minors, or any content that could be construed as grooming or exploitation of children. This is strictly prohibited and will result in immediate account termination and reporting to law enforcement authorities.
• Generate content depicting sexual violence, non-consensual acts, or any illegal sexual content
• Generate content that promotes hate, violence, terrorism, or discrimination against any group
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated systems to extract data without permission
• Resell or redistribute our service without authorization
• Circumvent or attempt to bypass any content safety filters or moderation systems

Content Moderation: Inktoxicated utilizes third-party AI services to generate content. While we implement safety measures, we do not pre-screen, review, or approve all AI-generated content before it is presented to you. You are solely responsible for reviewing, moderating, and ensuring the appropriateness of all content generated through our platform before publishing, distributing, or sharing it. Inktoxicated bears no responsibility for the nature, accuracy, or legality of AI-generated outputs.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The service is provided "AS IS" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We do not guarantee uninterrupted or error-free service
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not responsible for the content of books you create, their commercial success, or any legal consequences arising from content you generate, publish, or distribute
• We are not liable for any content generated by third-party AI systems accessed through our platform, including but not limited to content that may be offensive, inappropriate, inaccurate, or unlawful. You assume all risk associated with the use, publication, and distribution of AI-generated content.
• We are not liable for any claims, damages, or legal actions arising from content you create, publish, or distribute using our service, including claims related to defamation, copyright infringement, obscenity, or any other content-related claims

Indemnification

You agree to indemnify, defend, and hold harmless Inktoxicated, its owners, operators, officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of the service or any content you generate, create, publish, or distribute
• Your violation of these Terms of Service or any applicable law or regulation
• Any content created through your account, whether by you or any third party accessing your account
• Any claim that content generated through your use of the service caused harm to a third party, including but not limited to claims of defamation, obscenity, intellectual property infringement, or violations of laws protecting minors
• Your failure to review, moderate, or ensure the appropriateness and legality of content before publication or distribution

Refund Policy

We want you to be satisfied with our service. Our refund policy is as follows:

• Refund Window: You may request a full refund within 48 hours of your purchase or the start of your current billing period.
• After 48 Hours: Once 48 hours have passed since your purchase or billing date, refunds are no longer available for that billing period.
• Case-by-Case Review: If you have a specific concern or extenuating circumstance after the 48-hour window, please contact us and we will review your case individually.
• How to Request: To request a refund, please contact us with your account email and reason for the refund.

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our service at any time. We may also update these terms, and continued use of the service constitutes acceptance of revised terms.

Termination

We may terminate or suspend your account at any time for violations of these terms. Upon termination:

• Your right to use the service ceases immediately
• You should download any content you wish to retain
• We may delete your data after a reasonable period
